International Association on Collaboration in Arbitration Matters

Chapter 1

Name of the Association

1.1. The name of the association is International Association on Collaboration in Arbitration Matters (hereinafter – Association).

1.2. The website: www.iacam.uk.

 

Chapter 2

Goals of the Association

The goals of the Association are as follows:

2.1. popularizing of arbitration at the international level;

2.2. promotion of amicable settlement of disputes among entrepreneurs at the international level;

2.3. exchange of experience and knowledge in the field of arbitration both among members of the Association and among entrepreneurs;

2.4. provision of assistance on matters related to the arbitration process to all interested parties;

2.5. informing on the procedure of recognition and execution of judgments of foreign courts of arbitration in each separate country;

2.6. assistance in preparation of recommendations and opinions concerning the arbitration procedure;

2.7. networking and cooperation among members of the Association from different countries;

2.8. promotion of professional growth of members of the Association.

 

Chapter 3

Tasks of the Association

To attain its goals, the Association has set the following tasks:

3.1. develop and implement a joint program for collection and processing of information on recognition and execution of judgments of international courts of arbitration in each separate country;

3.2. represent interests of members of the Association and promote their networking and cooperation;

3.3. participate in activities of international professional associations and establish contacts with colleagues from other countries;

3.4. coordinate the development of the quality of arbitration services;

3.5. provide assistance to members of the Association in consulting companies and individuals on matters related to international arbitration;

3.6. provide assistance to members of the Association in consulting companies and individuals on matters related to local arbitration in each separate country;

3.7. train and prepare specialists in the field of arbitration and promote their professional growth;

3.9. undertake public actions to attain the set goals of the Association;

3.10. spread information about its activities, inter alia through training and seminars;

3.11. collaborate with public organizations of other countries.

 

Chapter 4.

Membership in the Association, Admission and Expulsion of Members

4.1. Membership in the Association is free of charge.

4.2. Membership in the Association is open to an individual who is an expert in the field of arbitration of a certain country (hereinafter – Candidate for Membership) who meets the criteria set for a member of the Association and who shares and supports the goals of the Association.

4.3. Members of the Association do not participate in the running of the Association. The Association is run by the Board. Director of the Association appoints the Board of the Association that keeps records of members, builds a relationship with the members, and is involved in carrying out the tasks of the Association (Chapter 2).

4.4. A Candidate for Membership seeking to join the Association shall send an application to the Association along with proof that he meets the criteria set for a member of the Association.

4.5. A decision about admission to the Association is taken by the Board of the Association. The Board reviews the application within one month after receiving all required documents.

4.6. The Board notifies the applicant of its decision in writing. The Board does not explain its decision regarding acceptance or denial of the candidate. The decision is final and is subject to no appeal.  A Candidate has the right to reapply for membership in the Association one year after being denied.

4.7. The member is free to leave the Association at any time after serving written notice to the Board of the Association.

4.8. The Board of the Association is free to expel a member from the Association at any time after serving notice to the member of the Association by post or by email in the event if:

4.8.1. the member of the Association does not comply with the Code of Ethics of Members of the Association;

4.8.2. the member of the Association does not meet his obligations;

4.8.3. the member of the Association is engaged in the activities that are in conflict with the goals and tasks of the Association; or

4.8.4. the member of the Association is not in line with the tasks set before the Association.

4.9. The Board of the Association discusses expulsion of a member at its next meeting to which the person to be expelled is not invited. The Board is free not to provide any explanations as to the reason for the expulsion. The decision of the Board regarding the expulsion is subject to no appeal.

4.10. In the event of withdrawal of a member from the Association as well as in the event of expulsion from the Association, no compensation or financial remuneration is paid. The parties shall not require from each other any compensation.

 

Chapter 5

Rights of the Member of the Association

The member of the Association has the following rights:

5.1. be one of the opinion formers in his country on the matters of arbitration;

5.2. receive information on activities of the Association, get acquainted and exchange information with other members of the Association;

5.3. participate in events held by the Association and make suggestions aimed at improving activities of the Association;

5.4. on his own behalf provide services of a specialist in the field of arbitration to all interested parties applying for the services through the Association;

5.5. withdraw from the Association.

 

Chapter 6

Responsibilities of the Member of the Association

The member of the Association has the following responsibilities:

6.1. comply with the Internal Rules of the Association;

6.2. comply with the Code of Ethics of Members of the Association;

6.3. promote the goals and tasks of the Association;

6.4. not to impose reputational or financial damage on the Association.

 

Chapter 7

Governing Body of the Association

7.1. The Board is the governing body of the Association. Director of the Association appoints and dismisses the Board.

7.2. The Board acts in compliance with the Internal Rules of the Association.

7.3. Members of the Board elect Chairman and Deputy Chairmen from their ranks who organize the work of the Association.

7.4. The Board organizes activities of the Association.

7.5. The Board is entitled to handle all the matters that do not fall under the competence of Director of the Association.

7.6. Chairman of the Board has the right to represent the Association individually. Each Deputy Chairman has the right to represent the Association only together with Chairman.
